TRS to move court over deferring elections in two assembly seats
Terming the Election Commission’s (EC) decision not to hold bypoll in two out of 12 Assembly seats in Telangana as “unconstitutional”, TRS tonight said it will move court against the poll panel’s decision.
“By-elections were supposed to be held for 12 seats.
But the Election Commission today announced that election will be held for 10 seats. The decision not to hold the bypoll in two constituencies of Vemulawada and Sircilla is against the spirit of the Constitution,” TRS President K Chandrasekhar Rao told reporters here.
“According to the Section 151 (A) of the Representation of People’s Act, bypolls should be held and vacancy filled in six months. The law gives two reasons for not holding the election. One, either the remainder of the term is less than one year and if there is any sort of difficulty like law and order problem in conducting the polls.
There is no such problem in the two seats. Hence, the EC’s decision is wrong,” the former Union Minister stated.
He said the reason cited by EC that election petitions are pending over the two seats was “wrong” as the sitting MLAs had quit.
TRS has obtained legal opinion and decided to challenge the EC decision in the AP High Court, Rao said.
He alleged the EC’s decision could be the result of a conspiracy by ruling Congress. “This is an example of using Constitutional bodies for political purposes.

Even constitutional bodies (Highest order of Doctrines) themselves being used for settling political scores,
Where is the sanctity of having constitutional guarantees or articles? Constituion on paper/books minimal or nominal. One more example of violating the constitution or defeating the purpose of democratic spirit.
SKC's repeated harping of inclsuion of Telangana constitutional guarantees will be defeated/violated, that itself is the GENESIS of this TELANGANA movement.

the funny thing in this is ,,,
if i file a case in each constitution against the ruling candidates before 2014 elections will EC stop all the elections,,
How funny is this isn't simple common sense.
Even court verdict is finalized and the candidate who files this case goes for supreme court again ,,,again the case is pending again ,,,So the people of vemulawada and siricilla are going to be without any representation for 10 -15 yrs if the case is not solved,,,,
This ia all because they are born as telganites ,,,,,,
